Terms of service

Terms & Conditions

Last updated: October 15, 2026

Welcome to Moments Etched.

These Terms & Conditions explain the basic rules that apply when you visit momentsetched.com, purchase a product, submit artwork, request a custom project, purchase supplies or equipment, or otherwise do business with Moments Etched Inc.

We have written these terms in plain language so you know what to expect from us and what we need from you.

By placing an order, submitting a quote request, approving a custom project, or using our website, you agree to these Terms & Conditions and the other applicable policies referenced below.

Other products may be sourced, special-ordered, drop-shipped, freight-shipped, manufactured, serviced, or fulfilled through third-party manufacturers, distributors, and suppliers.

Product-specific terms displayed on a product page, quote, invoice, proof, order confirmation, or Custom Product Agreement also apply to the applicable transaction.

2. Placing an Order

Please review your order carefully before submitting it.

You are responsible for confirming that the information you provide is accurate, including, when applicable:

  • Names, dates, initials, addresses, and personalized text;

  • Garment sizes and colors;

  • Paper, substrate, material, finish, and product selections;

  • Quantities;

  • Artwork and design selections;

  • Print, transfer, engraving, or production locations;

  • Gang sheet dimensions and artwork;

  • Equipment model and configuration;

  • Shipping and freight information;

  • Need-by dates; and

  • Any other customization or product instructions.

Submitting an order does not prevent us from contacting you if clarification, artwork changes, payment, supplier confirmation, proof approval, or additional information is required.

We reserve the right to decline or cancel an order when reasonably necessary, including orders involving:

  • Unavailable or discontinued products;

  • Obvious pricing or technical errors;

  • Suspected fraud;

  • Prohibited or unlawful content;

  • Intellectual-property concerns;

  • Supplier limitations;

  • Unsafe or incompatible production requirements; or

  • Production requirements that we cannot reasonably fulfill.

If Moments Etched cancels an order and the applicable product has not already been purchased, produced, customized, committed, or otherwise made non-refundable on the customer's behalf, the applicable payment will be refunded.

3. Product Categories & Return Eligibility

Return and cancellation eligibility depends on the type of product purchased.

Standard Retail Products

Non-personalized products that have not been specially ordered, installed, used, or otherwise designated as final sale may be eligible for return according to our Return & Refund Policy.

Custom & Personalized Products

Products created, printed, engraved, transferred, cut, assembled, labeled, or otherwise produced specifically for a customer are generally final sale once production begins.

Custom Paper & Stationery

Wedding stationery, event stationery, business printing, invitations, cards, programs, menus, signs, and similar custom-printed products are generally final sale once the applicable proof has been approved or production has begun.

Custom Transfers & Gang Sheets

DTF, UV DTF, and other custom transfers or gang sheets produced from customer-submitted artwork or specifications are custom products and are generally final sale once production begins.

Special-Order Products & Equipment

Products specifically ordered from a manufacturer, distributor, or supplier for a customer's purchase may become non-cancellable and non-refundable once the supplier order has been submitted.

Product pages, quotes, invoices, and order confirmations may contain additional return or cancellation conditions applicable to a particular item.

4. Custom & Personalized Products

Custom and personalized products are produced specifically for you.

Because these products generally cannot be resold, completed custom or personalized products are normally final sale except when an item is damaged, defective, or produced incorrectly by Moments Etched.

Customer-entered or customer-approved mistakes do not generally qualify as production defects.

Examples include:

  • Incorrect spelling;

  • Incorrect names or dates;

  • Incorrect garment sizes;

  • Incorrect quantities;

  • Incorrect addresses;

  • Incorrect artwork supplied by the customer;

  • Incorrect personalization selections; or

  • Errors that were visible in an approved proof.

Please review our Return & Refund Policy for additional information.

5. Wedding, Event & Custom Paper Products

Wedding stationery and other printed paper products may include:

  • Invitations;

  • Save-the-dates;

  • RSVP cards;

  • Programs;

  • Menus;

  • Place cards;

  • Thank-you cards;

  • Inserts;

  • Envelopes;

  • Signs;

  • Business stationery; and

  • Other printed or specialty paper products.

Customers are responsible for carefully reviewing names, dates, times, addresses, spelling, punctuation, quantities, artwork, and other content before approving a proof.

Once a proof is approved or production begins, custom paper products generally cannot be changed, cancelled, returned, or refunded.

Paper, envelopes, specialty stocks, handmade materials, foil, ink, toner, cutting, scoring, finishing, and other physical production processes may result in minor variations between individual pieces or production batches.

Digital previews are intended to represent the finished product as accurately as reasonably possible but are not an exact physical representation of paper texture, finish, color, weight, or production appearance.

If a selected paper, envelope, stock, finish, or specialty material becomes unavailable, we will contact you before making a substitution that would materially change the finished product.

6. Artwork Authorization

When you upload, email, submit, or otherwise provide artwork, logos, photographs, text, trademarks, designs, or other content, you represent that you:

  • Own the content;

  • Created the content;

  • Have obtained permission or a license to reproduce it; or

  • Otherwise have the legal authority to authorize its reproduction.

You authorize Moments Etched and our applicable production partners to reproduce the submitted material as reasonably necessary to produce and fulfill your order.

You are responsible for obtaining any required permission from the copyright, trademark, or other intellectual-property owner.

Moments Etched may decline or stop an order when we reasonably believe that reproducing the submitted material could violate another party's intellectual-property rights or applicable law.

7. Artwork Quality

Customers should provide the highest-quality artwork reasonably available.

Whenever possible, production-ready vector artwork or high-resolution raster artwork is preferred.

Low-resolution artwork, screenshots, compressed images, photographs of logos, improperly prepared transparent files, or other poor-quality source files may not reproduce as clearly as professional artwork.

We may contact you if we believe a file requires correction or replacement before production.

If additional artwork preparation, cleanup, recreation, vectorization, design, or layout services are required beyond the services included with your purchase, we will communicate any applicable additional charge before performing billable design work.

8. Digital Proofs & Approval

Digital proofs may be available for custom orders when offered during customization or when required by Moments Etched.

If you request a digital proof, production will not begin until the proof has been approved.

Requesting a proof may extend your production timeline.

Customers are responsible for carefully reviewing proofs for:

  • Spelling;

  • Names;

  • Dates and times;

  • Addresses;

  • Artwork;

  • Colors;

  • Layout;

  • Placement;

  • Dimensions;

  • Quantities; and

  • Other visible production details.

Once a proof is approved, Moments Etched may produce the order according to the approved information.

Errors that were visible in an approved proof generally do not qualify for a free replacement or refund.

If you choose to proceed without requesting an optional proof, production may proceed using the artwork, selections, personalization information, and specifications submitted with your order after our internal production review.

If clarification is required, we will contact you before proceeding.

9. Production Time

Production time begins only after all requirements necessary for production have been completed.

Depending on the order, this may include:

  • Required payment or deposit;

  • Artwork submission;

  • Personalization information;

  • Product or material availability;

  • Supplier confirmation;

  • Approval of a requested or required proof; and

  • Any additional information required to produce the order.

Production times shown on our website, quotes, or communications are estimates unless Moments Etched expressly confirms a guaranteed deadline in writing.

Different product categories may have different production schedules.

Large orders, specialty printing, complex artwork, multiple production locations, wedding stationery, custom paper products, gang sheets, equipment orders, custom branding, supplier availability, or other special requirements may require additional time.

Production time and shipping time are separate.

10. Natural Product, Color & Production Variations

Custom production involves physical products, materials, equipment, printing processes, and human handling.

Small variations are normal and are not necessarily defects.

Examples may include:

  • Slight differences in print, transfer, cut, or engraving placement;

  • Minor differences in artwork scale across different product or garment sizes;

  • Slight differences in garment dimensions or construction;

  • Natural variations in wood, leather, acrylic, paper, fabric, or other materials;

  • Minor variations in engraving depth;

  • Differences between paper, garment, substrate, or material production batches;

  • Slight differences between screen colors and finished product colors;

  • Minor variations between individual printed pieces; and

  • Differences caused by the surface, substrate, or material on which a design is produced.

Digital Screens vs. Printed Color

Colors viewed on a phone, tablet, computer monitor, television, or other digital screen are typically displayed using RGB color.

Physical printing may use CMYK, process colors, spot colors, Pantone references, DTF inks, toner, specialty inks, or other production methods.

Screen brightness, device settings, monitor calibration, garment color, paper stock, substrate color, material type, ink, transfer process, heat application, and other production factors may affect the appearance of the finished color.

Moments Etched will make reasonable efforts to reproduce submitted artwork and colors as accurately as our available production methods, materials, and equipment allow.

However, an exact screen-to-production color match cannot be guaranteed based solely on a digital preview.

For projects requiring a specific or closely controlled color, customers may request a Pantone color sample, printed color sample, or other available color-matching sample before full production.

Additional charges and production time may apply.

For apparel decoration, minor placement differences of approximately 1/2 inch or less may occur depending on garment construction, garment size, seams, collars, production method, and selected decoration location.

We use alignment and quality-control processes to keep production consistent, but perfectly identical placement and color reproduction on every physical item cannot always be guaranteed.

11. DTF, UV DTF & Custom Gang Sheets

DTF, UV DTF, and other custom transfer products are produced according to the artwork, dimensions, quantities, and specifications submitted with the order.

When a customer submits a completed gang sheet, the customer is responsible for confirming:

  • Artwork dimensions;

  • Artwork spacing and layout;

  • Resolution and image quality;

  • Transparent backgrounds where required;

  • Correct orientation;

  • Quantity; and

  • Other production specifications shown on the applicable product page.

Moments Etched may perform a reasonable production review but is not responsible for redesigning or correcting customer-created gang sheets unless design or layout services have specifically been purchased or agreed upon.

Minor color and dimensional variations inherent to printing and cutting processes may occur.

Custom-produced transfers and gang sheets are generally final sale once production begins.

Customer-Applied Transfers

Customers purchasing transfers for their own application are responsible for using appropriate:

  • Application equipment;

  • Temperature;

  • Press time;

  • Pressure;

  • Peeling method;

  • Substrate or garment; and

  • Application instructions.

Application results may vary based on heat-press calibration, pressure, actual platen temperature, substrate composition, garment characteristics, environmental conditions, and application technique.

Moments Etched is not responsible for transfer damage or application failure caused by incorrect customer application, incompatible materials, improperly calibrated equipment, or failure to follow applicable instructions.

When Moments Etched applies the transfer as part of a completed-product order, our normal custom-production standards apply.

12. Garment Sizing

Apparel sizing may vary between manufacturers, product styles, garment types, and production batches.

Customers are responsible for reviewing available size charts and selecting appropriate sizes before ordering.

A size selected incorrectly by the customer is not considered a production defect.

13. Inside-Neck Labels & Custom Branding

Inside-neck label replacement is available only on garments whose original manufacturer label can safely and appropriately be removed or replaced.

Certain garments may contain sewn-in, legally required, or otherwise non-removable labels that are not eligible for replacement.

Custom customer branding is subject to the same artwork-authorization requirements described in these Terms.

Availability and pricing of neck-label options will be displayed during customization or included in the applicable quote.

14. Special-Order Equipment

Certain equipment sold through Moments Etched may be identified as:

  • Special Order;

  • Vendor Order;

  • Manufacturer Order;

  • Drop Ship;

  • Freight Item; or

  • Similar terminology.

This may include:

  • DTF printers;

  • UV DTF systems;

  • Powder shakers and curing systems;

  • Heat presses;

  • Cutting and finishing equipment;

  • Large-format production equipment;

  • Specialized accessories; and

  • Other products ordered specifically from a manufacturer or distributor for a customer's purchase.

Special-Order Sales Are Final

When a product is identified as a special-order item, Moments Etched may place a non-cancellable purchase with a manufacturer, distributor, or supplier specifically to fulfill your order.

Once the applicable supplier or manufacturer order has been submitted, the special-order purchase is final and generally cannot be cancelled, returned, or refunded.

This includes cancellation requests resulting from:

  • A change of mind;

  • Ordering the wrong model or configuration;

  • Changes to the customer's business plans;

  • Financing issues after purchase;

  • Failure to verify equipment dimensions;

  • Failure to verify electrical requirements;

  • Failure to verify ventilation requirements;

  • Failure to verify compressed-air requirements;

  • Failure to verify computer or software requirements;

  • Failure to verify facility requirements;

  • Inability to accommodate the equipment at the delivery location; or

  • Other circumstances unrelated to an error by Moments Etched, qualifying shipping damage, applicable warranty coverage, or rights that cannot legally be waived.

Customer Responsibility Before Ordering

Before purchasing equipment, customers are responsible for reviewing and confirming applicable:

  • Product dimensions;

  • Product weight;

  • Electrical voltage;

  • Amperage;

  • Electrical phase;

  • Outlet and circuit requirements;

  • Ventilation requirements;

  • Compressed-air requirements;

  • Computer and software requirements;

  • Environmental requirements;

  • Door, hallway, elevator, and facility clearances;

  • Loading and unloading requirements;

  • Installation requirements; and

  • Applicable local electrical, ventilation, fire, building, or safety requirements.

Customers are encouraged to contact Moments Etched before ordering if clarification about a published product specification is needed.

15. Equipment Availability & Supplier Orders

Equipment inventory and supplier availability may change without notice.

An equipment order may be subject to supplier or manufacturer confirmation before fulfillment.

If a manufacturer or distributor advises us that an ordered product cannot be supplied, we may offer:

  • A revised lead time;

  • An alternative product;

  • A different configuration; or

  • Cancellation and refund of the affected item when the original supplier order has not otherwise become binding or non-refundable.

Customers are not required to accept a materially different substitute.

16. Freight Shipping & Large Equipment Delivery

Some equipment and oversized products ship by commercial freight rather than standard parcel delivery.

Freight delivery may differ substantially from ordinary residential package delivery.

Unless expressly included on the product page, quote, invoice, or order confirmation, freight delivery does not automatically include:

  • Inside delivery;

  • Equipment installation;

  • Uncrating;

  • Assembly;

  • Electrical connection;

  • Rigging;

  • Forklift service;

  • Movement into a building;

  • Removal of packaging; or

  • Other specialized delivery services.

Residential delivery, liftgate service, scheduled appointments, limited-access delivery, inside delivery, redelivery, storage, or other freight services may result in additional charges.

The customer is responsible for ensuring that the delivery location can safely receive the shipment and that appropriate people, space, access, and equipment are available when necessary.

Inspect Freight Before Signing

Whenever reasonably possible, inspect freight shipments before signing the carrier's delivery receipt or bill of lading.

If visible damage is present:

  1. Photograph the pallet, crate, packaging, equipment, and visible damage;

  2. Clearly document the damage on the carrier's delivery paperwork before signing;

  3. Do not sign a statement indicating that the shipment was received in good condition when visible damage is present; and

  4. Contact Moments Etched promptly with photographs and applicable delivery documentation.

If the damage is severe, contact Moments Etched and follow the freight carrier's applicable procedures regarding acceptance or refusal of the shipment.

Concealed damage discovered after unpacking should be photographed and reported as soon as reasonably possible within the applicable freight carrier or manufacturer claim period.

Failure to document visible freight damage at delivery may affect the ability to pursue a carrier claim.

Missed or Unavailable Freight Delivery

Additional carrier charges caused by inaccurate delivery information, unavailable recipients, unsuccessful scheduled delivery, storage, redelivery, additional requested services, or delivery conditions not disclosed before shipment may be the customer's responsibility.

Freight delivery dates are estimates unless expressly guaranteed by the carrier.

17. Equipment Warranties & Technical Support

Equipment warranties vary by manufacturer, distributor, and product.

When equipment includes a manufacturer or distributor warranty, the applicable warranty terms provided for that product govern warranty coverage.

Depending on the product, warranty support may be administered by:

  • The manufacturer;

  • The distributor;

  • An authorized service provider;

  • Moments Etched; or

  • A combination of these parties.

Certain equipment components, printheads, inks, consumables, maintenance items, and wear components may have separate warranty periods or exclusions.

Customers should review the warranty information applicable to the equipment before purchase and upon delivery.

A special-order product being non-refundable does not eliminate an otherwise valid manufacturer or distributor warranty.

Unless Moments Etched expressly provides a separate written warranty, we do not expand or replace a manufacturer's stated equipment warranty.

18. Product Availability & Substitutions

We work with outside manufacturers, distributors, and suppliers for many garments, paper products, substrates, transfers, supplies, equipment, and production materials.

Products, colors, sizes, stocks, finishes, equipment models, and materials may occasionally become unavailable or discontinued.

If this occurs, we may contact you with options such as:

  • Waiting for the original product;

  • Selecting a comparable substitute;

  • Adjusting the affected portion of the order; or

  • Receiving a refund for the affected item when an acceptable substitute is unavailable and the order has not otherwise become non-refundable.

We will not intentionally substitute a materially different custom product or piece of equipment without communicating with you.

19. Pricing, Discounts & Quotes

Prices and promotions may change over time.

The amount shown when an order is completed, or the amount stated on an accepted quote or invoice, governs that transaction unless an obvious pricing or technical error occurred.

Group discounts, promotional discounts, credits, coupons, and other offers are subject to their stated eligibility requirements and may not always be combined.

Orders requiring custom bulk pricing may be routed through our quote process instead of normal online checkout.

A quote is based on the:

  • Quantities;

  • Products;

  • Artwork;

  • Production methods;

  • Decoration locations;

  • Equipment;

  • Materials;

  • Freight requirements;

  • Shipping requirements; and

  • Other specifications known when the quote is prepared.

Changes to the project may result in revised pricing.

Supplier pricing, freight rates, tariffs, manufacturer surcharges, and other third-party charges may change before a special-order quote is accepted.

Any material price change will be communicated before the applicable special-order purchase is submitted whenever reasonably possible.

20. Payment

Website orders must be paid according to the payment terms displayed during checkout.

Custom quotes, equipment purchases, large projects, business orders, school orders, fundraising projects, special-production orders, or other projects may have separate payment or deposit requirements stated in the applicable quote or invoice.

Production generally does not begin until required payment or deposit has been received unless otherwise agreed in writing.

Special-order equipment may require full payment before Moments Etched submits the order to the applicable supplier or manufacturer.

21. Need-By Dates & Rush Orders

If an order is needed for an event, wedding, school function, business event, fundraiser, or other specific date, please provide the need-by date before production begins.

We will make reasonable efforts to meet accepted deadlines.

However, a requested need-by date is not guaranteed unless Moments Etched specifically confirms the deadline.

Orders requested within a shortened production window may require rush production and may be subject to an additional rush fee.

Rush service is available only when we confirm that the requested timeline can reasonably be accommodated.

Expedited shipping does not automatically shorten production time.

Manufacturer lead times, special-order equipment, and freight shipments generally cannot be treated as rush-production orders unless expressly confirmed.

22. Changes & Cancellations

If you need to change or cancel an order, contact us as soon as possible.

We will make reasonable efforts to accommodate changes before production or supplier commitment begins.

Changes or cancellations may no longer be possible after we have:

  • Ordered products or materials specifically for your project;

  • Submitted a special-order purchase to a manufacturer or distributor;

  • Prepared billable artwork specifically for production;

  • Begun printing;

  • Begun personalization;

  • Begun engraving;

  • Begun cutting;

  • Begun transfer production;

  • Begun assembly;

  • Begun finishing; or

  • Otherwise incurred nonrecoverable costs for the order.

Depending on the status of the project, some or all amounts already paid may be non-refundable.

Special-order equipment is additionally subject to the Special-Order Equipment provisions above.

23. Damaged, Defective or Incorrect Orders

We stand behind our work.

If an item arrives damaged, defective, or materially different from the approved or submitted production specifications because of an error by Moments Etched, please contact us promptly according to our Return & Refund Policy.

We may request:

  • Photographs;

  • Measurements;

  • Packaging;

  • Shipping documentation;

  • Freight documentation;

  • Serial numbers;

  • Videos; or

  • Other information reasonably necessary to evaluate the issue.

When an issue is confirmed to have resulted from a Moments Etched production error, we will provide an appropriate resolution, which may include correction, replacement, reproduction, refund, credit, or another reasonable remedy depending on the circumstances.

Normal product and production variations described in these Terms are not considered defects.

Equipment damage, freight claims, and manufacturer defects may be subject to separate freight or warranty procedures.

24. Shipping & Delivery

Production time and shipping time are separate.

Delivery estimates provided by shipping or freight carriers are estimates and may be affected by:

  • Weather;

  • Carrier delays;

  • Holidays;

  • Incorrect addresses;

  • Freight scheduling;

  • Manufacturer lead times;

  • Natural disasters;

  • Service interruptions; or

  • Other circumstances outside our reasonable control.

Customers are responsible for providing an accurate and complete delivery address.

Mixed-product orders may ship separately and may arrive at different times.

Please review our Shipping Policy and applicable product-specific delivery terms for additional information.

25. Customer-Supplied Products

Moments Etched may, at our discretion, agree to decorate, print, engrave, transfer, cut, or otherwise modify an item supplied by a customer.

Customer-supplied products can respond unpredictably to:

  • Heat;

  • Pressure;

  • Laser energy;

  • Adhesives;

  • Ink;

  • Transfers;

  • Engraving;

  • Cutting; or

  • Other production methods.

Special risk, replacement, or liability terms applicable to customer-supplied merchandise may be communicated before we accept the project.

Customers should not provide irreplaceable or highly sentimental items for processing unless the associated production risk has been discussed and accepted.

26. Intellectual Property of Moments Etched

Unless otherwise stated, original:

  • Designs;

  • Artwork;

  • Website graphics;

  • Product photography;

  • Templates;

  • Branding;

  • Logos;

  • Written content;

  • Gang-sheet templates; and

  • Other original materials

created by Moments Etched remain the property of Moments Etched or their respective licensors.

Purchasing a physical product, transfer, or printed item does not automatically transfer ownership of the underlying Moments Etched artwork or intellectual property unless expressly agreed in writing.

You may not reproduce, distribute, resell, publish, or commercially use Moments Etched-owned artwork or design assets without authorization.

27. Website Use

You may use our website for lawful shopping, customization, project planning, account management, quote requests, and communication with Moments Etched.

You may not intentionally:

  • Interfere with the operation or security of the website;

  • Attempt unauthorized access;

  • Introduce malicious software;

  • Circumvent website security;

  • Impersonate another person;

  • Use our website for unlawful activity; or

  • Misuse our services in a way that harms Moments Etched, our customers, or our service providers.

We may restrict access when reasonably necessary to protect our customers, website, business, suppliers, service providers, or legal rights.

28. Accessibility

Moments Etched is committed to providing a website and shopping experience that is accessible and usable by as many people as reasonably possible, including individuals with disabilities.

We continue to review and improve the accessibility and usability of momentsetched.com and use recognized web-accessibility guidance, including the Web Content Accessibility Guidelines (WCAG) 2.2, as a guiding benchmark for our accessibility efforts.

Our efforts may include improvements involving:

  • Keyboard navigation;

  • Focus indicators;

  • Form labels and instructions;

  • Error identification;

  • Color contrast;

  • Alternative text;

  • Heading structure;

  • Accessible customization controls;

  • Proofing workflows;

  • Screen-reader compatibility; and

  • Alternatives to interactions that rely solely on a mouse or pointer.

Because our website includes interactive customization, personalization, artwork-upload, preview, proofing, payment, and third-party features, accessibility is an ongoing process.

For additional information about our accessibility efforts, assistance, and how to report an accessibility issue, please review our Accessibility Statement:

Our accessibility efforts and this section do not limit any rights or remedies available under applicable law.

29. Errors & Information on Our Website

We make reasonable efforts to keep product information, availability, prices, photographs, colors, dimensions, equipment specifications, production information, and other website content accurate.

Occasionally, an error may occur.

We reserve the right to correct an obvious pricing, description, inventory, specification, or technical error before fulfillment.

If an error materially affects your purchase, we will make reasonable efforts to contact you.

If you do not wish to proceed under materially corrected information, an applicable cancellation or refund may be provided when the affected item has not already become customized, produced, committed, or non-refundable.

30. Shopify & Third-Party Services

Our online store is hosted using Shopify.

We may also use manufacturers, distributors, payment processors, shipping carriers, freight companies, applications, software providers, analytics providers, production partners, and other third-party services to operate our business and fulfill orders.

Purchases from Moments Etched are transactions with Moments Etched.

Shopify provides ecommerce technology and related services but is not the seller of Moments Etched products.

Certain products may be manufactured, shipped, serviced, or warranted through third-party manufacturers or distributors.

Third-party functionality and services may also be subject to the applicable provider's terms, policies, warranties, or service conditions.

31. Privacy

Your use of our website is also subject to our Privacy Policy.

Our Privacy Policy explains how Moments Etched and applicable service providers collect, use, disclose, and process personal information associated with our website and transactions.

32. Limitation of Liability

To the fullest extent permitted by applicable law, Moments Etched will not be responsible for indirect, incidental, special, or consequential losses resulting from use of our website, products, supplies, transfers, or equipment.

Customers purchasing production equipment are responsible for determining whether the equipment is appropriate for their intended application, facility, electrical service, ventilation, production environment, and other operational requirements.

Nothing in these Terms is intended to waive, restrict, or eliminate rights or remedies that cannot legally be waived under applicable law.

33. Governing Law

These Terms & Conditions and transactions with Moments Etched are governed by applicable United States law and other laws applicable to Moments Etched and the applicable transaction, except where consumer-protection or other applicable law requires otherwise.

34. Changes to These Terms

We may update these Terms & Conditions as our products, services, suppliers, technology, policies, or legal obligations change.

The current version will be published on this page with an updated revision date.

Changes apply prospectively unless otherwise required by applicable law.

35. Related Policies & Agreements

These Terms & Conditions should be read together with our:

  • Return & Refund Policy;

  • Shipping Policy;

  • Privacy Policy;

  • Accessibility Statement;

  • Custom Product Agreement, when applicable;

  • Product-specific warranty information;

  • Freight or delivery terms applicable to specific products;

  • Product-page terms; and

  • Any written quote, invoice, proof, or project-specific terms provided for an order.

If specific written terms for a custom project, special-order product, equipment purchase, quote, invoice, or other transaction conflict with these general Terms & Conditions, the more specific written terms will control for that transaction to the extent permitted by applicable law.
